The Office of Licensing licenses services pursuant to §37.2-404. The Department licenses services providing treatment, training, support and habilitation: to individuals who have mental illness, mental retardation or substance abuse disorders; to individuals receiving services under the Individual and Family Developmental Disabilities Support Waiver; or to individuals receiving services in residential facilities for individuals with brain injuries. Licensing staff make at least one unannounced inspection of services per year and investigate complaints in licensed services.

- The Background Investigations Unit was formed to execute the criminal background check process for Licensed Private Providers. The Background Investigations Unit conducts criminal background checks for applicants who accept employment in direct consumer care positions.
To be licensed by DMHMRSAS the applicant must:NOTE: Children’s Residential Services are licensed through a different process.
- Submit and receive preliminary approval of the initial application, [and required attachments]
- Submit, receive approval of, and demonstrate knowledge of required licensing policies, procedures and forms
- Have an on-site review of the physical plant, to include interviews with applicants over the content of their service description and policies and procedures, as well as compliance with other regulations, and copies of forms and sample client and personnel records
- Submit and receive approval of required Human Rights Policies and Procedures
- Affiliate with a Local Human Rights Committee, (LHRC)
- Request the LHRC to approve their Human Rights Policies and Procedures
- Set up an account and request criminal history and central registry background investigations for identified staff as required as required by Virginia Code §37.1-183.3, and submit Child Protective Services reference checks.

As part of the licensing process we are strongly encouraging new applicants to attend a training session here at the Licensing Central Office. Training for all services, except for the licensing of Residential Facilities for Children is scheduled one Wednesday of each month. Training for applicants applying to operate a Residential Facility for Children is generally scheduled one Thursday of each month. Usually training is held in the 5th floor conference room of the DMHMRSAS. The training runs between 9 AM until Noon.
You are strongly encouraged to attend, with your program director, prior to submitting your application. Please call 804-786-1747 to register to attendance. Pre-registration is required; seating is limited and these training sessions fill up quickly. Read document with details and directions to training
